These terms govern your use of Perfio, a perfume marketplace operated in the Republic of Panama. By using the site you accept these terms. If you do not agree, please do not use the service. These terms are governed by Panama's Law No. 51 of 2008 on Electronic Commerce and other applicable regulation.
1. Acceptance of terms
By creating an account or making a purchase on Perfio you confirm that you have read, understood, and accepted these terms and the Privacy Policy.
If you use Perfio on behalf of a business (for example, as a vendor), you represent that you have authority to bind it.
2. User account
You are responsible for the accuracy of the data you provide (name, contact, address). Keep it up to date.
You are responsible for the confidentiality of your access. Notify us immediately if you suspect unauthorized access.
We may suspend accounts that violate these terms, engage in fraud, or use Perfio for unlawful purposes.
3. Marketplace model
Perfio is a platform connecting independent stores ("vendors") with end customers. Products are listed against a canonical catalog maintained by the Perfio team.
The vendor is responsible for the authenticity, description, and existence of the inventory it lists. Perfio does not manufacture or distribute products directly.
Prices shown to the customer are the final visible price: they include the platform's margin. The commercial details between Perfio and each store are governed by separate contracts.
4. Orders and availability
Stock availability is updated at payment time. In rare cases an order may be cancelled if inventory ran out before payment was confirmed; in that case you receive a full refund.
Prices and availability may change without prior notice. The confirmed price is the one in effect at the time the payment is approved.
Each order receives a number formatted as ORD-YYYYMMDD-XXXX, which is used for all subsequent tracking.
5. Payments
In phase 1 we accept Yappy. In phase 2 we will enable card payments via FAC, subject to bank approval.
Perfio collects the full order amount (products + delivery) and then settles the vendor's share after the daily cutoff and corresponding confirmation.
We never store full card data. That information goes directly to the payment processor.
6. Platform commission
Perfio charges a 7.5% commission on each order's product subtotal. The commission does not apply to delivery fees, which are handled in full by Perfio.
The commission is automatically deducted at vendor settlement time. This figure is transparent and appears on every vendor cutoff.
7. Delivery
Delivery is performed in districts and neighborhoods covered by Perfio or by the designated logistics partner. The fee is calculated at checkout based on the destination.
Delivery times are estimates and depend on the area, vendor availability, and events outside our control.
It is the customer's responsibility to provide a valid address and contact person to receive the order.
8. Responsibilities
Customer: provide accurate data, receive the order at the indicated address, and report any inconsistency within the relevant timeframes.
Vendor: ensure product authenticity and accurate descriptions, keep stock up to date, and meet agreed preparation times.
Perfio: operate the platform with reasonable availability, process payments, coordinate logistics, and mediate disputes as set out in this section.
9. Dispute resolution
If a problem arises with an order (wrong product, undelivered, damaged), the first step is to contact the store directly from the order page.
If you cannot reach an agreement, you can escalate to Perfio support by emailing soporte@perfio.com.pa. We will mediate between the parties based on the available evidence.
If the dispute is not resolved through mediation, the parties may turn to the competent authorities of the Republic of Panama.
10. Limitation of liability
Perfio acts as a technology intermediary between customers and stores. We do not manufacture products and we do not guarantee the individual performance of each vendor beyond the contractual obligations we assume with them.
To the extent permitted by Panamanian law, we are not liable for indirect damages or lost profits arising from the use of the site.
Nothing in this section limits the consumer rights granted by Law No. 51 of 2008 or by Panama's Consumer Protection Law.
11. Changes to these terms
We may update these terms to reflect operational, legal, or product changes. When we make material changes we will announce them on the site and update the "last updated" date at the top.
If you continue using Perfio after a change, you are deemed to have accepted the new version. If you do not agree, you can close your account.
12. Legal framework
These terms are governed, among others, by Law No. 51 of July 22, 2008 on Electronic Commerce, the Consumer Protection Law, and other Panamanian regulation applicable to electronic commerce, marketplaces, and consumers.
13. Governing law and jurisdiction
These terms are interpreted under the laws of the Republic of Panama. The parties submit to the jurisdiction of the courts of Panama City for any controversy not resolved through mediation.
The official currency for all transactions is the United States dollar (USD), legal tender in Panama.
